HeyJamiez Website Terms of Use

These Terms of Use govern your use of www.heyjamiez.com and every directory on it: JamiezCarez, JamiezCarz, JamiezJobz, JamiezPetz and JamiezProz. They replace any earlier terms posted on the former JamiezJobz, JamiezPetz and JamiezCarz sites, which now redirect here.

1. Who we are and what you are agreeing to

The Site is operated by Jamiez LLC, a California limited liability company based in San Jose, California ("Jamiez," "we," "us"). By visiting, searching, submitting a listing, or otherwise using www.heyjamiez.com or any page, directory, or tool on it (the "Site"), you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover the Site only. Membership terms are not part of these Terms. They are in the membership contract you accept when you join, and in the Hey Jamiez App (app.heyjamiez.com) and its mobile versions. If you are a member, the membership contract and App terms also apply to your membership and to the App. If they conflict with these Terms on a membership or App matter, they control for that matter.

2. What the Site is, and what it is not

The Site is a neighborhood directory. It helps people find local providers across five directories: JamiezCarez (care services), JamiezCarz (auto repair, detailing and car care), JamiezJobz (trades, repairs and everyday help), JamiezPetz (grooming, walking and pet services), and JamiezProz (professional services).

Jamiez is not a party to any arrangement between a person who finds a provider and that provider. On the Site, Jamiez does not:

  • employ, supervise, or direct any listed provider, or act as their agent, staffing agency, or contractor
  • sell, perform, guarantee, or schedule any service a provider offers
  • take payment for provider services, set provider prices, or hold funds
  • recommend a particular provider as right for your needs

Providers are independent businesses and individuals. You and the provider decide whether to work together, the scope, the price, and the terms. Any service agreement is between the two of you.

If Jamiez later offers booking, payment, or concierge services through the Hey Jamiez App, those are governed by separate terms presented at that time, not by these Terms.

3. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Site beyond browsing. If you submit a listing for a business, you confirm you are authorized to bind that business to these Terms.

If you create a profile or submit information, you must give accurate, current information and keep any login credentials secure. You are responsible for activity under your credentials. Tell us promptly at the contact address in Section 19 if you suspect unauthorized use.

4. Provider listings

If you submit a listing, you represent that everything in it is true, that you have the right to publish it (including any photos, logos, and descriptions), and that you will keep it current. You grant Jamiez a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and promote your listing on the Site, in the Hey Jamiez App, and in Jamiez marketing, for as long as the listing is live and a reasonable time after.

Listings are reviewed before publication. We may approve, edit for format, decline, suspend, or remove any listing at any time, for any reason, without liability. Approval is not an endorsement, certification, or guarantee of the provider or their work. Jamiez does not verify every statement in a listing.

You are responsible for operating lawfully. That includes holding every license, registration, permit, bond, and insurance policy your services require, and complying with employment, worker-classification, tax, consumer-protection, and advertising laws. Do not list a service you are not legally permitted to perform.

Provider-specific rules by directory:

  • JamiezCarez. Listings may not offer medical, nursing, or other licensed health care, or in-home care for compensation, unless the provider holds every license or registration California requires, and says so in the listing.
  • JamiezCarz. Auto repair listings must state the provider's Bureau of Automotive Repair registration number where required.
  • JamiezJobz. Contractors must state their California Contractors State License Board license number on any listing, and in any advertisement, where the law requires a license for the work offered.
  • JamiezPetz. Providers are responsible for any permits, insurance, and animal-care requirements that apply to boarding, grooming, or in-home care.
  • JamiezProz. Licensed professionals (attorneys, accountants, and similar) must list only services within their license, include any disclosures their licensing body requires, and must not use the Site in a way that breaks advertising or solicitation rules for their profession.

5. Finding, contacting, and hiring providers

You are responsible for choosing whom to contact and hire. Before you do:

  • confirm the provider's identity, license, registration, and insurance with the issuing agency or the provider directly (for contractors, the CSLB license lookup; for auto repair, the Bureau of Automotive Repair)
  • get the scope, price, schedule, and warranty in writing
  • use your own judgment about safety, especially before letting anyone into your home, near your children or pets, or into your vehicle

Contact between you and a provider happens directly. Jamiez does not mediate disputes, guarantee that a provider will respond, show up, or perform, or refund or compensate you for provider work. If a problem arises, your recourse is against the provider.

In an emergency, call 911. Do not use the Site for emergencies.

6. Licenses, verification, and no background checks

Jamiez does not perform background checks, criminal-history checks, or identity screening on providers listed in the directory, and does not describe any provider as screened or vetted. Listings are reviewed before publication only for completeness and fit with the Site's rules, not to verify a provider's character, skill, licensing, insurance, or history.

Where a listing shows a license number, registration, insurance note, or similar statement, it is the provider's own statement. It may be out of date or wrong, and Jamiez does not guarantee that any provider is licensed, insured, bonded, or qualified. Check it yourself with the issuing agency or the provider, and consider getting your own references or screening before you hire anyone, especially for work in your home or involving children, seniors, or pets.

7. Reviews, ratings, and your content

You may submit reviews, ratings, questions, photos, and other content ("User Content"). You keep ownership of it, and grant Jamiez a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, reproduce, and distribute it in connection with the Site and our services.

Reviews must reflect your own genuine experience. Do not post a review of your own business or a competitor's, a review in exchange for payment or a free service, a review on behalf of someone else, or anything false, misleading, defamatory, or harassing. Providers may not offer incentives for positive reviews or retaliate against reviewers. We may remove or decline User Content at our discretion, and we do not edit reviews to change their meaning. We are not liable for User Content posted by others.

8. Memberships and the Hey Jamiez App

The Site may show membership offers and link to the Hey Jamiez App. Membership terms, pricing, renewal, cancellation, and refund terms are not stated on the Site. They are set out in the membership contract and the Hey Jamiez App at app.heyjamiez.com, and you accept them there. Nothing on the Site is an offer to enter a membership on any particular terms. Please read the membership contract before you pay for or accept anything.

9. Prohibited conduct

Do not:

  • use the Site for anything unlawful, fraudulent, deceptive, or harassing
  • impersonate a person or business, or misstate your license, credentials, or affiliation
  • scrape, crawl, harvest, or bulk-copy listings, reviews, or contact details, or use them to build a competing directory or for unsolicited marketing
  • send spam or unsolicited commercial messages to providers or other users through the Site
  • interfere with the Site's security or operation, probe or test its vulnerabilities, or bypass access controls
  • upload malware or anything that could harm the Site or other users
  • use automated tools, bots, or AI agents to submit listings or reviews, or to contact providers at scale, without our written permission
  • use the Site to discriminate unlawfully against anyone

We may investigate violations and take any action we think appropriate, including removing content, suspending access, and reporting conduct to authorities.

10. Intellectual property and copyright complaints

The Site, its design, text, graphics, the Jamiez name and logo, and the names JamiezCarez, JamiezCarz, JamiezJobz, JamiezPetz, JamiezProz, and Hey Jamiez are owned by Jamiez LLC or its licensors and protected by law. You get a limited, revocable, non-transferable license to use the Site for personal, non-commercial purposes, or, if you are a provider, to manage your own listing. All other rights are reserved. Do not use our marks without written permission.

If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent at the contact address in Section 19. Include your signature, identification of the work and the infringing material and its location, your contact details, a statement of good faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and you own or are authorized to act for the owner. We may end access for repeat infringers.

11. Third-party sites and services

The Site links to and displays information about third parties, including providers' own websites, maps, and payment or scheduling tools. We do not control or endorse them and are not responsible for their content, practices, or terms. Your dealings with them are your own risk and subject to their terms.

12. Privacy

Our Privacy Policy explains how we collect, use, and share personal information, including the rights California residents have. It is part of these Terms. Contact details you submit in a listing are published as part of the listing.

13. Disclaimers

THE SITE AND ALL LISTINGS, REVIEWS, AND INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT CALIFORNIA LAW ALLOWS, JAMIEZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. JAMIEZ DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LISTING, LICENSE STATEMENT, BADGE, OR REVIEW IS ACCURATE, COMPLETE, OR CURRENT.

Jamiez does not provide legal, medical, financial, veterinary, automotive, or other professional advice. Listings in JamiezCarez and JamiezProz are advertisements, not professional advice or the start of a professional relationship. Content on the Site is general information only.

14. Limitation of liability

TO THE FULLEST EXTENT CALIFORNIA LAW ALLOWS, JAMIEZ AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR FROM ANY SERVICE, ACT, OR OMISSION OF A PROVIDER OR OTHER USER. JAMIEZ'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

These limits do not apply to liability that cannot be excluded by law, including for fraud, gross negligence, or willful misconduct. California Civil Code section 1668 and similar rules limit what a party may excuse in advance, and nothing here is meant to go beyond them. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party," but only for claims against Jamiez arising from your use of the Site.

15. Indemnity

You agree to defend, indemnify, and hold harmless Jamiez and its members, managers, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your listing, your services as a provider, your breach of these Terms, or your violation of law or another person's rights. We may take over the defense of any matter at our expense, and you will cooperate.

16. Disputes and governing law

California law governs these Terms and any dispute about the Site, without regard to conflict-of-law rules. Before filing a claim, each side will first try to resolve it informally: write to us at the contact address in Section 19 with a description of the dispute, and allow 30 days for good-faith discussion.

If informal resolution fails, the state courts in Santa Clara County, California, or the U.S. District Court for the Northern District of California, have exclusive jurisdiction, and you and Jamiez consent to them. Claims may be brought only on an individual basis, not as a class or representative action, to the extent the law allows. Nothing here limits your rights to file complaints with a government agency.

17. Changes and termination

We may change these Terms at any time by posting the updated version with a new effective date. Your continued use of the Site after that date means you accept the change. If a change is material, we will give notice on the Site. We may change, suspend, or discontinue any part of the Site, and may suspend or end your access or any listing at any time, with or without notice. Sections that by their nature should survive termination will survive, including 4 (license grant), 7, 10, 13, 14, 15, and 16.

18. General terms

These Terms, together with the Privacy Policy and any membership contract or App terms that apply to you, are the entire agreement between you and Jamiez about the Site. If a provision is unenforceable, the rest stays in effect, and the provision will be enforced to the maximum extent allowed. Our failure to enforce a right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, sale, or reorganization. Notices to you may be given by posting on the Site or by email to an address you provided. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Jamiez, or between Jamiez and any provider.

19. Contact and California consumer notice
